Step 1: The Audit

The audit will be one of the most important steps that your company will undergo with regard to your immigration matters.  It consists of the collection, review, and reporting by us of the immigration status of your employees and how they might be able to remain in Canada in the future. 

Individual circumstances can differ extensively and the categories of work permits and permanent residence in which your employees would qualify for will likely be varied.  The audit will provide a clear picture for your company as to how long each employee should be able to remain in Canada, what your company should be prepared to do to have your employees remain in Canada, and some of the qualities your company should look for in future employees should you wish them to remain in Canada on a long-term basis.

Step 2: The Notice

We will provide your company with reminders of when we should begin the extension process for each of your employees’ work permits or the application process for your employees’ permanent residence.  Immigration is an extremely time-sensitive process.  A missed deadline can mean an unnecessary forced departure of an employee from Canada.  That is why the onus should be on your lawyers to provide you with the necessary reminders for your immigration matters.

Step 3: The Assessment

At the beginning of the application process for the work permit / permanent residence for each employee, we will undergo another assessment of the current situation, which may have changed from the time of the audit, and determine the immediate strategy for application.  At this time, we will communicate with your employee and the HR representative at your office and provide them with instructions as to how the application will proceed and answer any initial questions they may have.

Step 4: The Training

We will also provide seminars to your company’s HR department to provide them with ongoing training and education about Canada’s immigration policies so that they can be aware of issues that can affect their recruitment strategies, assist in monitoring employee’s work activities, and provide guidance on the long-term planning of your company’s labour management.

Step 5: The Preparation of the Application

After the assessment, we will provide your employee and your HR representative with written instructions and a list of documents that we will need from them for the application.  We will work together with them to collect the documentation and information for the application.  We pride ourselves on being accessible to all of our clients and we will send reminders where timing requires and will always be on hand to answer any questions your company or your employees may have.

We also guarantee efficiency in the preparation of the application.  We guarantee that the application will be prepared with our legal submissions completed and the application package ready to send within 3 business days of the receipt of the last required documentation from your company and the employee.

Step 6: The Follow-up of the Application with the Government Officials

After the application is submitted, it is essential that your legal representatives are on hand to ensure that the application is delivered within proper government guidelines with regard to timelines and evaluation policies.  We will advocate on your employees’ behalf with regard to your applications and deal with any concerns that officers may have.  Should any problems arise, we will discuss with you alternative solutions to meet your business needs.  Due to the auditing and assessment precautions that we would undertake before we submit the applications, the chances of these problems arising should be significantly minimized.

Step 7: The Receipt of the government approval and final advice to the employee and employer about future actions.

Once government approval is received, we will provide your employee with the documentation and notify your company of the result.  We will also provide your employees with advice about the restrictions on their activities that they must abide by to legally remain in Canada.
